If you are negatively impacted by the Goodyear layoff, please be assured there are options the Court may consider to help you through these circumstances. During this time, it is likely you may face a loss of income which may make it impossible to make Plan payments during the unemployment period. While my office may not forgive or reduce Plan payments, there are options available which the Court may order suspensions or reductions in Plan payments. Alternatively, and based on a case’s specific circumstances, a loss of household income may mean a better option is to convert or dismiss your case. You must review all options with your attorney. Therefore, if your household has lost income because of the layoff, and cannot make your Plan payment and pay your monthly living expenses, please contact your attorney to explore which option is best for you.
Your attorney will need, at least, the following information:
1) Details about the changed income circumstances
2) Proof of all current household income, which may include unemployment sources, part time jobs, social security sources or any other source of current income
3) Your future employment prospects or other sources of funds you will receive to live
4) Details of any changes to your current household expenses
5) A list of any debt you owe since the bankruptcy case was filed
6) Any other information your attorney may seek should be provided as he or she requests
You should, at a minimum, ask your attorney how each option will or will not impact your current situation:
1) An amended plan to forgive or reduce Plan payments. Some cases have mortgages or car loans where forgiven plan payments will not be possible, but a reduced Plan payment may work.
2) Conversion to another bankruptcy chapter
3) Dismissal of your case
